1. OVERVIEW OF SERVICES
   Welcome to the Lunas Advertising LLC website (the "Site"), owned and operated by Lunas Advertising LLC ("Lunas Advertising," "we," "us," or "our"). We provide marketing services tailored to the healthcare industry and beyond, including, but not limited to, ad content creation, social media advertising, lead generation, and marketing strategy development. By using or accessing any services on this Site (the "Services"), you agree to comply with and be bound by these Terms of Service (the "Agreement").

   Please carefully review this Agreement and our Privacy Policy, which is incorporated herein by reference. If you do not agree with these terms, please do not use our Site or Services.

2. USER ELIGIBILITY AND RESPONSIBILITIES
   You represent that you are at least 18 years of age and have the authority to enter into this Agreement. You agree to provide accurate and complete information when using our Site and Services and to comply with all applicable laws and regulations.
   

3. PAYMENT TERMS
   A. Fees
   Fees for Services are specified in individual agreements or order forms. Payment must be made in U.S. dollars and in accordance with the payment terms outlined in the specific Service agreement. Lunas Advertising LLC reserves the right to modify fees, with any changes applying only to new agreements or renewals.

   B. Timing and Cancellation
   Payments are due as outlined in your specific agreement. You may cancel Services at any time by contacting us via email at hello@lunasadvertising.com.
   If cancellation occurs:

   • Prior to the campaign launch date: A full refund, including the fixed service fee and unused ad budget, will be issued.

   • After the campaign launch date but less than halfway through its duration: A refund of 50% of the fixed service fee and the remaining unused budget will be issued.

   • After more than half the campaign's duration has passed: Only the remaining unused budget will be refunded; the fixed service fee is non-refundable.

   Thank you for understanding that significant resources are allocated during campaign preparation and execution, making certain costs non-refundable.

4. SERVICE TERM AND TERMINATION
   The service term begins upon Lunas Advertising LLC's acceptance of the agreement and continues as specified. The terms outlined in Section 3.B govern cancellations and refunds.
   

5. PRIVACY AND DATA SECURITY
   We take your privacy seriously and adhere to all applicable data protection laws. Please refer to our Privacy Policy for more details on how we collect, use, and protect your information.
   

6. INTELLECTUAL PROPERTY
   All intellectual property related to our Services, including but not limited to content, software, and trademarks, remains the exclusive property of Lunas Advertising LLC and/or its licensors. We grant you a limited, non-exclusive license to use the Site and Services solely for your personal or business use. Any unauthorized reproduction, distribution, or modification is prohibited.
   

7. USER-GENERATED CONTENT
   By submitting content to our Site or Services, you grant Lunas Advertising LLC a worldwide, royalty-free license to use, modify, and display such content as necessary for Service delivery. You represent that you have the necessary rights to submit this content and that it does not infringe on third-party rights.
   

8. INDEMNIFICATION
   You agree to indemnify and hold Lunas Advertising LLC and its affiliates, officers, and employees harmless from any claims, damages, or expenses arising from your use of the Site or Services or from any violation of this Agreement, including any third-party claims.
   

9. DISCLAIMER OF WARRANTIES
   Lunas Advertising LLC provides its Services "as is" and "as available" without any warranty of any kind, express or implied. We do not guarantee that our Services will be uninterrupted or error-free. Your sole remedy for dissatisfaction with the Site or Services is to discontinue use.
   

10. LIMITATION OF LIABILITY
    To the fullest extent permitted by law, Lunas Advertising LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits or business interruption, arising from or related to the use of the Site or Services. Our liability is limited to the amount paid by you in the 12 months preceding the incident giving rise to liability.
    

11. CHANGES TO TERMS
    Lunas Advertising LLC reserves the right to modify these Terms of Service at any time. Changes will be posted on this page, and your continued use of the Site or Services following such changes signifies your acceptance of the new terms.
    

12. DISPUTE RESOLUTION
    In the event of any dispute arising from or related to this Agreement, the parties agree to attempt resolution through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in Sacramento, California, under the rules of the American Arbitration Association.
    

13. GOVERNING LAW
    This Agreement shall be governed by the laws of the State of California without regard to conflict of law principles. Any legal action shall be filed in the state or federal courts located in Sacramento, California.
